Please read these Terms and Conditions carefully before engaging Clearbrook's services. By contacting us to arrange care, or by continuing to use our services, you confirm that you have read, understood, and agreed to these terms.

3. Service Description

Clearbrook provides in-home elderly care services in Taichung, Taiwan, including Afternoon Companion Visits, Post-Hospital Recovery Support, and Comprehensive Family Care Plans. Services are delivered at the Client's home address as agreed in the care plan.

All service descriptions are provided in good faith. We reserve the right to adjust service delivery if safety concerns arise at the Client's home or if the Client's care needs change significantly.

5. Service Delivery and Scheduling

Agreed visit times will be maintained to the best of our ability. In the event of an aide's absence, we will make reasonable efforts to provide a substitute with appropriate notice. Clearbrook is not liable for delays caused by circumstances beyond our control (e.g. severe weather, public transport disruption).

Scheduling changes requested by the Family Representative should be made at least 24 hours in advance where possible.

8. Scope Limitations

Clearbrook aides are not licensed medical professionals. They do not diagnose conditions, administer medications, perform clinical procedures, or substitute for professional medical or nursing care. Any health concern observed during a visit will be communicated to the Family Representative promptly.

If a Client's needs exceed the scope of our services, we will advise the family and may recommend appropriate professional alternatives.

9. Intellectual Property

All content on the Clearbrook website and care documents is owned by or licensed to Clearbrook. You may not reproduce, distribute, or repurpose any materials without written permission.

10. Confidentiality

All information about Clients and their families is treated as confidential. We will not share it with third parties outside the scope described in our Privacy Policy without explicit consent, except where legally required.

11. Disclaimers

Services are provided in good faith with reasonable skill and care. We cannot guarantee specific outcomes — including health improvement, behavioural change, or full recovery — as these depend on factors outside our control.

We strongly recommend that families maintain their own relationship with the Client's treating medical professionals and do not rely solely on Clearbrook's observations for medical decision-making.

12. Limitation of Liability

To the extent permitted by applicable law, Clearbrook's liability in connection with any service is limited to the fees paid for that specific service period. We are not liable for indirect, consequential, or incidental losses.

We maintain appropriate professional indemnity insurance for our care activities.

13. Indemnification

You agree to indemnify Clearbrook against claims arising from inaccurate information provided by the Family Representative, or from requests made to aides that fall outside the agreed service scope and result in harm or liability.

14. Termination

Either party may terminate the service arrangement with reasonable written notice. Clearbrook reserves the right to terminate immediately where: a) the safety of personnel is at risk; b) the Family Representative provides materially false information; c) payment obligations are not met despite reasonable notice.

15. Dispute Resolution

In the event of a dispute, both parties agree to first attempt informal resolution by contacting us at [email protected]. If unresolved within 30 days, disputes shall be referred to the competent courts of Taichung City, Taiwan, under the laws of the Republic of China (Taiwan).

16. Governing Law

These Terms and Conditions are governed by the laws of the Republic of China (Taiwan). Any interpretation or enforcement is subject to Taiwanese jurisdiction.

17. Changes to These Terms

We may update these Terms periodically. The revised version will be published at the same URL with a new effective date. Continued use of our services after changes take effect constitutes acceptance of the revised terms.
